U.S. Senators Katie Britt and Ted Cruz, both members of the Senate Judiciary Committee, have introduced the Agent Raul Gonzalez Officer Safety Act. This legislation aims to criminalize fleeing from agents or officers performing their duties.
Senator Britt emphasized the importance of supporting border patrol agents and law enforcement officers who risk their lives daily. "Our border patrol agents and law enforcement officers put their lives on the line every single day to protect our nation, and we owe it to them to ensure they have the tools and resources they need to do their jobs safely and effectively," said Senator Britt. She noted that the legislation honors Agent Gonzalez, who died while protecting American citizens, aiming to prevent similar tragedies.
The bill is named after Border Patrol Agent Raul Gonzalez Jr., who died in pursuit of illegal aliens near Mission, Texas. It seeks to permanently bar any illegal alien fleeing from Border Patrol from receiving legal immigration status in the United States.
Senator Cruz highlighted the bill's message against endangering American lives: "This legislation honors the sacrifice of Agent Raul Gonzalez, Jr., who lost his life pursuing individuals evading capture. It sends a clear message that if you endanger American lives, you will face serious consequences."
The proposed act also stipulates penalties for those fleeing from law enforcement assisting Border Patrol, with up to two years in prison as a possible sentence. If injuries occur during pursuit, sentencing could range from 5 to 20 years; if death results, a life sentence could be imposed. Additionally, it requires the Department of Justice to report on prosecutions under this act.
Companion legislation was introduced in the U.S. House by Rep. Juan Ciscomani and passed with a vote of 264-155.
The introduction of this bill follows other immigration-related efforts supported by Senator Britt aimed at enhancing national safety. Last month saw President Donald Trump sign into law her S.5 Laken Riley Act, which included amendments mirroring other legislative proposals focused on law enforcement protection.
On her recent legislative success with S.5 Laken Riley Act, Senator Britt remarked: "This is an incredible first step toward making America safe again, and I will continue fighting to strengthen border security and interior immigration enforcement."
