U.S. Senators Katie Britt and Todd Young have introduced the Fair and Open Competition Act (FOCA) to prevent federal mandates on project labor agreements (PLAs) for taxpayer-funded projects. Senator Britt emphasized that "federal contracts should be awarded based on merit, not special interests," criticizing PLAs as costly and discouraging competition among qualified contractors.
The proposed legislation aims to increase bidding opportunities, enhance workforce competition, reduce construction costs, and save taxpayer dollars. Senator Britt had previously supported the FOCA in the 118th Congress.
Senator Young described the act as "pro-worker legislation" intended to restore competition in the construction industry while protecting workers from discriminatory contracts. He noted his personal connection to small businesses and union members, stating that the bill ensures fair bidding processes based on merit.
Alabama is one of 24 states with laws against government-mandated PLAs for state-level projects. Additionally, Senator Britt supports the National Right to Work Act, which she claims would protect workers from compulsory union dues amidst economic challenges under the Biden-Harris Administration.
Alabama has maintained its right-to-work status since 1953, with a constitutional amendment affirming this position passed by voters in 2016.
